Terms

  1. Seller
    MapMyWall operates under the authority of PHIA cv. PHIA cv has its registered office at 3020 Winksele, Belgium, Vilvoordsebaan 73, and is registered in the Central Enterprise Databank (Kruispuntbank der Ondernemingen, KBO). The VAT number is BE0866 746 864.
  2. Application
    By placing an order, the Purchaser accepts our terms and conditions, which form an integral part of the agreement, excluding all other general or specific terms and conditions from the part of the Purchaser, unless explicitly stated otherwise in writing. 
  3. Quotes and accepting orders
    All our quotes are non-binding. We are only bound by an order after we have confirmed in writing or after we have started executing the order. Information about products and pricing, as well as detailed order information, is drafted and supplied subject to change and correction.
  4. Delivery
    Products will only be shipped to countries for which shipment is allowed according to the website. If possible, products will be delivered within the time frame supplied in the individual order confirmation.
    Wrongly submitted delivery addresses are the sole responsibility of the Purchaser and may lead to extra costs. 
    Unless stated otherwise, our prices do not include shipment and delivery of the goods to the Purchaser. Shipment and delivery costs are stated separately.
    The delivery terms stated are non-binding and are given purely as an indication. No delay in delivery can give rise to the breaking of the purchase or the paying of damages to the Purchaser, except in the case of deliberate intent.
    We have the right to make partial deliveries. 
    In the event of non-delivery of the goods, any sums paid by the Purchaser will be reimbursed without interest or any other form of compensation.
  5. Reservation of ownership
    The delivered goods remain our property until the price has been paid in full, including all costs and expenses, default interests and compensations. In the event of non-payment, we reserve the right to take the goods back, legally and at the expense of the Purchaser.
  6. Complaints
    To be admissible, complaints need to reach us: (a) in the case of a complaint about a non-conform delivery, eight (8) days after delivery, and (b) in the case of hidden defects, eight (8) days after discovery of the defect or after the moment on which such discovery could have been made in a reasonable way. The acceptance of the goods by the Purchaser covers any possible defect or non-conformity that could have been discovered at that moment. 
  7. Guarantee
    Our guarantee is limited to the guarantee against hidden defects and the guarantee for consumer purchase, both provided for in the Civil Code. We can only be held liable for damage resulting from deliberate intent or gross error. We accept no liability for general or specific indirect damage of any kind, incurred by the Purchaser. 
  8. Right of cancellation
    Where distance selling to consumers is concerned, within the scope of the Law of 6 April 2010, the consumer has the right to inform the seller of his intent to cancel the purchase, without the payment of a fine and without having to give a reason, within fourteen calendar days counting from the day following the delivery. Should the Purchaser wish to make use of his right of cancellation, he has to return the goods in their original condition and packaging at his own risk and expense to Phia cv, Vilvoordsebaan 73, 3020 Winksele, Belgium. Goods specifically designed for the Purchaser or goods that can decay rapidly cannot be returned, in which case the Purchaser cannot make use of the right of cancellation.
  9. Force majeure
    We accept no liability for delays in the execution or the non-execution of our obligations due to events outside of our normal control, including production interruptions, difficulties in supplying or shortages of raw materials, manpower, energy or transport or delays in transport, strikes, lock-outs, work stoppages or other collective work disputes, affecting us or our suppliers, even if these events are foreseeable.
  10. Pricing and payment
    Invoices are payable at our registered office at Vilvoordsebaan 73, 3020 Winksele, Belgium, at the due date, net without discount, unless stated otherwise on the invoice. To be admissible, each complaint about the invoice has to be formulated in detail and sent by registered post within three (3) days after receipt of the invoice. In case of overdue payments, the open invoice amounts will be charged legally and without the need of any prior notice of default with interests of 1% per month counting from the invoice date. In the event of non-payment and if a reminder by normal letter has been without result for 14 days, a fixed damage compensation will be owed in the amount of 10% of the open amounts. In the event of partial or complete non-payment of an invoice at the due date or in case of any other breach of obligation under the agreement by the Purchaser, we reserve the right, legally and without notice of default, to suspend the execution of all agreements with the Purchaser or to terminate such agreements with immediate effect, without the need for any judicial intervention and to demand immediately all claims even if not expired, or to deliver only in exchange for cash payment, notwithstanding prior agreements and any other right we might invoke. Even if we do not take immediate action against a default on the part of the Purchaser, this can under no circumstances be considered a waiver of this default at a later stage. 
  11. Personal data
    By placing an order on the MapMyWall Internet site, the Purchaser explicitly allows the processing and use of his/her personal data for purposes such as the administration of the client database, the managing of orders, deliveries and invoices, the follow-up on solvability, marketing and publicity. Processing for marketing purposes and personalised publicity only takes place if the client has explicitly agreed to this during the ordering process. Phia cv will not be allowed to transmit the data to a third party. The Purchaser has the right to access and correct all data. Furthermore, the Purchaser has the right at all times and free of charge to refuse the processing of his/her data for direct marketing purposes. For more information, the Purchaser can apply to the public registry kept by the Commission for the Protection of Privacy in Brussels.
  12. Proof
    All Parties accept electronic proof within the frame of their relationships (e.g.: e-mail, back-ups, etc.).
  13. Severability
    If a clause of these terms and conditions should be declared null and void, this will not affect the validity of the other clauses.
  14. Applicable law
    All agreements with the seller are governed by Belgian law. The Belgian courts have exclusive jurisdiction. 
  15. Right of cancellation
    The consumer has the right to inform the company that he wants to cancel the purchase, without the payment of a fine and without having to give a reason, within fourteen calendar days counting from the day following the delivery or the signing of the service agreement.
  16. Exceptions
    For certain products and services, the client will not be able to cancel the purchase. The most important examples are: goods designed according to the clients specifications or with a personal character, goods that cannot be returned due to their nature, goods that can decay rapidly or become obsolete, audio and video recordings or software with the seal broken, newspapers, periodicals and magazines. In these cases, the client has no right of cancellation.
